Related Laws Protecting Leaves of Absences from Work


Pregnancy Leave laws

•  Pregnancy Discrimination Act: Under the U.S. Pregnancy Discrimination Act (“PDA”), it is illegal to discriminate against a pregnant women or women with related conditions. The PDA is located at Section 2000e(k) of Title 42 of the United States Code.
•  California Pregnancy Disability Leave Law: The California Pregnancy Disability Leave Law (“PDLL”) provides up to 4 months of leave to be taken all at once or as needed for a pregnancy, childbirth and related conditions. The PDLL is contained in the FEHA at Section 12945(b)(2) of the California Government Code. As with the CFRA and FMLA, an employee may not be fired or discriminated against for taking such leave. An employee who takes pregnancy leave under this law may take as addition 12 workweeks off for child care leave under the California Family Rights Act.
