You may be lawfully terminated during or after taking medical leave if your position is eliminated for reasons other than your medical leave. Additionally, you may not have a right to return to your job if your employer can't run its business safely and efficiently by leaving your job open. However, under this circumstance, you must be restored to a comparable position if available.
